1. Nature of the Platform — We Are an Intermediary

HealthWarriorsis an online intermediary marketplace platform as defined under the Information Technology Act 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021. We provide a technology platform that allows healthcare professionals (“Professionals”) and healthcare employers including hospitals, clinics, and diagnostic centres (“Employers”) to connect with each other.

We are not a recruitment agency. We are not an employer. We are not a placement service.We do not employ, place, recruit, or engage healthcare professionals on behalf of any employer. We do not act as agent for any user. Any employment, contractual, or professional relationship formed through the Platform is solely between the Professional and the Employer.

We are not a party to any agreement, negotiation, or transaction between Professionals and Employers. We have no control over and are not responsible for the accuracy of job postings, the suitability of candidates, employment decisions, salary payments, working conditions, professional conduct, or any outcome of any hiring process facilitated through the Platform.

2. Eligibility and Account Registration

• You must be at least 18 years of age to use the Platform.
• You must provide a valid Indian mobile number for OTP verification during registration.
• You must provide accurate, current, and complete information during registration and keep it updated.
• You are responsible for maintaining the confidentiality of your account. You must not share your account credentials or allow any other person to use your account.
• One person or organisation may hold only one account per user role. Creating multiple accounts is prohibited.
• We reserve the right to refuse registration or suspend any account at our sole discretion, without notice, if we believe the account violates these Terms or applicable law.

4. Prohibited Conduct

You must not use the Platform to:

• Post false, misleading, or fraudulent information, including fake qualifications, fake job postings, or fake employer profiles
• Charge any fee to candidates for job applications, interviews, or placement
• Collect or harvest personal information of other users beyond what is provided through the Platform's features
• Send unsolicited commercial messages (spam) to other users
• Engage in any activity that violates any applicable Indian law, regulation, or court order
• Impersonate any person or organisation
• Upload or share any content that is defamatory, obscene, harassing, or otherwise unlawful
• Attempt to gain unauthorised access to the Platform, its servers, or other users' accounts
• Use automated tools (bots, scrapers, crawlers) to access or extract data from the Platform
• Post job opportunities outside India without prior written approval from us

Violation of any of the above may result in immediate account suspension or termination, at our sole discretion, without refund of any subscription fees paid.

5. Job Postings and Applications

• Job postings are subject to review and approval. We reserve the right to reject or remove any job posting that violates these Terms or that we deem inappropriate, without notice or reason.
• We do not guarantee that any job posting will result in applications, interviews, or a successful hire.
• We do not guarantee that any application will result in a response, interview, or employment offer.
• Match scores displayed on the Platform are algorithmic indicators only and do not constitute a guarantee of suitability, performance, or employability.
• Employers are solely responsible for their hiring decisions. We expressly disclaim any responsibility for the outcome of any employment relationship formed through the Platform.
• Job postings expire after 30 days unless renewed. Expired postings are automatically closed and will no longer receive applications.

6. Subscriptions and Payments

• Certain features of the Platform require a paid subscription. Subscription fees, tiers, and features are described on the pricing page and are subject to change with advance notice.
• All payments are processed by Razorpay. We do not store payment card details.
• Subscription fees are billed in advance and are non-refundable except where required by applicable law or where the Platform is materially unavailable for an extended period due to our fault.
• Subscriptions automatically expire on their end date unless renewed. We are not liable for any job opportunities missed due to a lapsed subscription.
• All prices are inclusive of applicable GST unless stated otherwise. GST invoices are available on request.
• We reserve the right to change subscription prices. Existing subscribers will be notified at least 30 days before a price change applies to their renewal.

7. Intellectual Property

All content on the Platform — including but not limited to the website design, text, graphics, logos, icons, software, algorithms, and source code — is the property of HealthWarriors and is protected by Indian and international copyright and intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, or commercially exploit any part of the Platform without our prior written consent.

By submitting content to the Platform (including job postings, profile information, or messages), you grant us a non-exclusive, royalty-free, worldwide licence to use, store, display, and distribute such content solely for the purpose of operating and improving the Platform.

8. Content and Conduct

Users are solely responsible for all content they post on the Platform. We are not the author, publisher, or owner of user-generated content. As an intermediary under the IT Act 2000 (Section 79), we are not liable for any third-party content posted on the Platform, provided we act expeditiously upon receiving actual knowledge of unlawful content.

To report unlawful content or a policy violation, contact us at +91 93909 99614. We will review and, where appropriate, remove such content within the timeframes prescribed by applicable law.

9. Third-Party Services

The Platform may integrate with or link to third-party services (including Razorpay for payments and WhatsApp for communication). We are not responsible for the content, privacy practices, or availability of any third-party service. Your use of any third-party service is subject to that service's own terms and privacy policy.

10. Limitation of Liability

You agree to indemnify, defend, and hold harmless HealthWarriors and its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any content you post on the Platform; or (e) any dispute between you and another user of the Platform.

12. Dispute Resolution and Governing Law

We reserve the right to suspend, restrict, or terminate your account and access to the Platform at any time and for any reason, with or without notice, including for violation of these Terms, suspected fraud, or conduct that we believe is harmful to other users or to us.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately. Sections 7 (Intellectual Property), 10 (Limitation of Liability), 11 (Indemnification), and 12 (Dispute Resolution) survive termination.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page with a revised effective date and notify you through the Platform. Your continued use of the Platform after the revised Terms are posted constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Platform.
